I Guess I'm About to Violate Sarah Palin's 1st Amendment Rights

POSTED BY: Dennis DiClaudio

And I suppose that you're also violating her 1st Amendment Rights by reading this. Or at least aiding and abetting* my terrible hate crime upon the Constitution. So, I highly recommend that you just stop reading now before you get yourself implicated in this anti-American activity.

While exercising her 1st Amendment Rights on a conservative radio talk show, Constitutional scholar Sarah Palin very aptly pointed out how that most sacred of all U.S. documents protects her rights to make unsubstantiated and smear-mongering partisan claims against her political opponents.

And — more to the point — speaking out against, fact-checking or criticizing her statements in any way might cause her to feel compelled to not make such statements in the future.

Ipso facto, such activities are an infringement upon the Bill of Rights. Check and mate, monsieur comrade…

Palin told WMAL-AM that her criticism of Obama's associations, like those with 1960s radical Bill Ayers and the Rev. Jeremiah Wright, should not be considered negative attacks. Rather, for reporters or columnists to suggest that it is going negative may constitute an attack that threatens a candidate's free speech rights under the Constitution, Palin said.

"If [the media] convince enough voters that that is negative campaigning, for me to call Barack Obama out on his associations," Palin told host Chris Plante, "then I don't know what the future of our country would be in terms of First Amendment rights and our ability to ask questions without fear of attacks by the mainstream media."

Can you imagine the horror of that? A country in which politicians are held to a standard of honesty and decency, and members of the press are allowed to express opinions and print facts that aren't mandated by the state?

The citizenry would get to have total control over how they want their government run. There's a word for that!

Totalitarianism.

* Thanks for correcting my spelling, Mr. Sark. As always, I suck. However, I don't appreciate your attempt undermine my Consitutional right of Freedom of Spell.

  1. I wonder if Sarah is now so isolated by the far Right that no one even tells her when she makes these Constitutional gaffes….I mean, we know she doesn't read so how else is she going to learn?

I will say that she does remind me a great deal of George W…..interpreting things any ol' way she wants…you bet'cha!

  4. I could be wrong, but I thought the first amendment only protected you from being jailed or harassed by THE STATE, and not just any regular citizen who happens to call you out for being a fear-mongering whore.

For example: If I said that Sarah Palin was a fear-mongering whore, the state could not come and arrest or intimidate me to think otherwise. However, if it was somehow proven that by saying she was a fear-mongering whore I had somehow caused her actual personal anguish or financial ruin, then maybe she could file a civil suit for slander/libel, but she would have to prove to a reasonable degree that she was not, in fact, a fear-mongering whore. I think we can all agree that would be a tall order. In other words, the first amendment doesn't protect you from public opinion.

  5. It seems scarcely surprising that she'd not trouble herself to understand constitutional rights and guarantees as they apply to other people. I'm not sure she recognizes any other people. "Diva" is utterly inadequate to describe what has been reported by members of her own campaign.

  6. THANK GOD THIS DITZ WILL NEVER EVER BE PRESIDENT! YOU CAN GO BACK TO ALASKA NOW AND SHOOT MOOSE FROM A HELICOPTER. GOODBYE SARAH AND GOOD RIDDANCE. P.S. HAVE SOME MORE KIDS!

  7. lol…get over it…you sounded like poor losers for the last 8 years and now like poor winners. When will you learn that politics like sports or your favorite meal is personal and you don't have to shove your view down everyones throat. Ask Clarance Thomas about the right of people to say what they want. O…your probably to young or uniformed to understand the correlation. Grow up…please

  8. She should be sued for libel for the BS she said. And sentenced to look in the mirror at her own associations and corruption that aren't fabricated.

  9. I definitely agree with what Jerry said.

Everyone do themselves and their dignity a favor and take the win gracefully; otherwise, people who continue to insolently attack the other party only reveals the fact they are idiots and are incapable of making a valid argument.

Like Jerry said, everyone needs to just "grow up."

  10. oh what a bullcr@p article!

And I quote, " Can you imagine the horror of that? A country in which …members of the press are allowed to express opinions and print facts that aren't mandated by the state?

Members of the press? How about a country where "journalists" have to be licensed? Oh the horror?!?!?! Does that mean there is no freedom of the press?

Look, I just want to know that they understand their ethical obligations. Maybe it's the ugly side of living in a Perez Hilton sorta world. Wrap yourself in constitutional rights all you want..but my right to extend my arm…stops at the end of your nose.
