Supreme Court Won't Hear, Won't Rule on DADT Challenge
Not that anyone suspected any different, but it's still depressing…
The Supreme Court today declined to hear a constitutional challenge to the Pentagon's "don't ask, don't tell" policy banning openly gay people from serving in the U.S. military, a move that could effectively leave it to the Obama administration to resolve the long-controversial issue.
Well, that shouldn't be a problem. Since Obama was so outspoken in his support for ending DADT during the campaign last year, I'm sure he'll be doing everything in his power to resolve this controversy as soon as possible…
The Obama administration had asked the high court not to take the case, and White House officials had said they would not object to homosexuals being kicked out of the armed services.
That certainly is one way of resolving the controversy.

Whoops, this might help. Implicitly it is obvious (to me who forgot to write this) that if The Court would not reach the issue of gay marriage in Lawrence, it will not extend it to the military. Lawrence doesn't apply to anything except humping in certain ways.

If I were Justice Kennedy, I'd want this issue to be my legacy. I am hopeful he will make this fly before it's too late. Leaving it to the states is a total bunch of shit. Kennedy did author Lawrence v. Texas which allowed Texas to have what they've so desperately needed. He also allegedly wears pink underwear with rainbow triangles.
Keep the faith. I really think this is the functional equivalent of Jim Crow. It's sick. And frankly, while I can rationalize politically President Obama's decisions here, I find it incredibly intellectually insulting because he knows what the fucking right answer is but says another to garner votes.

The whole thing boils down to a Kennedy who's not even a Kennedy.
He went out of his way in Lawrence, as I recall, to mention the "anti dude-loving" Texas law violated a substantive due process right to liberty amongst other things. Kennedy explicitly stated the ruling striking down the Texas anti-sodomy law did not apply to gay marriage issues.
Ugh. That was so 2004.
Maybe I should write about this.
